1. Agreement to Terms

By accessing or using AutoSense Africa's website and services, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, then you may not access the service.

These Terms apply to all visitors, users, and others who access or use our services, including car buyers, sellers, dealers, and agents.

2. Description of Service

AutoSense Africa provides:

  • An online marketplace connecting car buyers with verified dealers
  • Dealer verification and KYC services
  • Vehicle inspection services
  • Agent services for vehicle transactions
  • Lead generation tools for dealers
  • Analytics and dashboard services

3. User Accounts

Account Creation

To use certain features of our service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Account Security

You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Account Types

  • Buyer Accounts: For individuals looking to purchase vehicles
  • Dealer Accounts: For businesses selling vehicles (subject to verification)
  • Agent Accounts: For AutoSense authorized agents

4. Dealer Terms

If you register as a dealer, you agree to:

  • Complete our verification process including KYC and physical inspection
  • Provide accurate and truthful vehicle listings
  • Maintain professional conduct with buyers
  • Comply with the Dealer Code of Conduct
  • Pay applicable subscription fees and commissions
  • Respond promptly to inquiries and leads

AutoSense Africa reserves the right to suspend or terminate dealer accounts that violate these terms or our Dealer Code of Conduct.

5. Vehicle Listings

When listing vehicles on our platform, dealers must:

  • Provide accurate descriptions, specifications, and pricing
  • Upload authentic photos of the actual vehicle
  • Disclose any known defects, accidents, or issues
  • Have legal authority to sell the vehicle
  • Update or remove listings when vehicles are sold

6. Payments and Fees

Subscription Fees

Dealers may be required to pay subscription fees to access premium features. All fees are non-refundable unless otherwise stated.

Transaction Fees

Certain services, such as inspections and agent services, may incur additional fees. These will be clearly communicated before you commit to the service.

Payment Processing

Payments are processed through our secure payment partners. We do not store your full payment card details.

7. Prohibited Activities

You may not use our service to:

  • Post false, inaccurate, or misleading content
  • Engage in fraud, scams, or deceptive practices
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Harass, abuse, or harm other users
  • Attempt to bypass security measures
  • Use automated systems to scrape or collect data
  • Interfere with the proper functioning of the service

8. Intellectual Property

The service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of AutoSense Africa and its licensors.

Our trademarks, service marks, and logos may not be used in connection with any product or service without the prior written consent of AutoSense Africa.

9. Limitation of Liability

AutoSense Africa acts as a marketplace platform connecting buyers and sellers. We do not own or take possession of vehicles listed on our platform.

To the maximum extent permitted by law, AutoSense Africa shall not be liable for:

  • The quality, safety, or legality of vehicles listed
  • The accuracy of listings
  • The ability of sellers to sell vehicles
  • The ability of buyers to pay for vehicles
  • Any disputes between users
  • Any indirect, incidental, or consequential damages

10. Dispute Resolution

We encourage users to first contact us to resolve any disputes. If a resolution cannot be reached, the dispute shall be resolved through arbitration in accordance with Nigerian law.

AutoSense Africa provides mediation services for buyer-dealer disputes when our Agent Service is used.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the service will cease immediately. If you wish to terminate your account, you may simply discontinue using the service or contact us.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
